Party Wall Services

The Party Wall etc. Act 1996 was introduced to prevent and resolve disputes in relation to party walls, boundary walls and excavations near neighbouring buildings.  Where certain conditions are met, Party Wall Notices lead to the statutory appointment of Party Wall Surveyors to agree works that can affect properties neighbouring a proposed development.

The individual or company responsible for instructing the intended development works is known as the Building Owner. It is the Building Owner’s legal obligation to issue Party Wall Notices on all affected Adjoining Owners to ensure that their interests are protected.

This should take place prior to the commencement of work on site, and with enough time before the project begins to allow for the formation of Party Wall Awards.

At The OM Group, we work with experienced and dedicated Party Wall Surveyors who can ensure that all information is considered so that Building Owners and the proposed developments are fully protected within the context of the Party Wall Act.  This enables construction works to commence smoothly on site and without delay.

In addition to this, other services that can be provided include the negotiation and agreement of access arrangements or licences for construction activities such as the erection of scaffolding or the over-sailing of cranes.

Adjoining Owners who receive Party Wall Notices, also have the right to appoint a Party Wall Surveyor to protect their interests.  Our surveyors have a depth of knowledge that can assist in anticipating the impact of the Building Owner’s proposed works.  This enables the Adjoining Owners to protect their interests and ensure that they have the information needed to make informed decisions.

Whether appointed as the Building Owner’s Party Wall Surveyor; acting on behalf of the Adjoining Owners or acting as the Agreed Surveyor, our partners are all experienced professionals and ensure that they provide expert advice and recommendations when administering the Party Wall Act.

Land and Boundary Disputes

Resolving land and boundary disputes is a complex and technical task.  It can be both stressful and time consuming.  We work with experienced and knowledgeable surveyors who can bring an independent and objective viewpoint to the proceedings by providing advice and guidance on the position of boundaries or any rights of land access that may exist.

Our partners are committed to providing technical information on all disputes and lay out the facts that assist the parties involved, as well as any appointed legal teams – bringing an unbiased and objective opinion to the proceedings.

Schedule of Condition

A ‘schedule of condition’ for a party wall is essentially a snapshot in time of the Adjoining Owner’s property. It is a visual assessment of a neighbouring property’s walls, floors, and ceiling surfaces. Visible portions of the external building envelope are also included in the schedule.

The schedule of condition report is produced before any work begins on site and surveyors document the state of the Adjoining Owner’s property in detail, which includes pictures of the condition of the property.

This report serves as proof of any alterations or damage that may be caused by the site works. The report details an accurate log of any defects discovered in the Adjoining Owner’s structure or boundary, so that after the work on-site is complete, any damage caused may be compared to the original condition of the property to determine it was not pre-existing.  This forms the basis for any remedial work which may be required.
